1. The auction or sale is conducted in the name of and for the account of the instructing party. By participating in this (m) auction/sale the bidder and the buyer understand the following general auction and sales conditions. They are an integral part of every sales agreement.

2. As per the wishes of the instructing party, the bidder/buyer is informed about the respective objects.

3. The objects shall be sold at the location in the condition which they are at the moment of the auction/sale. The buyer understands that all warranties are excluded and that the seller will not issue any guarantee for goods, condition, completeness, open or hidden defects, other damages or special properties. Technical data, measurements or weight information including year of manufacture and photos are non-binding as far as legally permitted. Lists of objects are prepared accurately and with good conscience.

4. The bidder/buyer is responsible for viewing the objects before purchasing. Catalog information is always subject to confirmation and without guarantee. The auction house, their legal representative or assistant is not liable for damages arising from injury to one's life, body or health.

5. Typically the objects are auctioned off by consecutive number. In certain cases we reserve the right to change the order, summarize items or factor them out. Any bid may be refused at our own discretion, an acceptance may be refused or accepted under reserve. In cases of doubt a bid acceptance may be cancelled or called out again.

6. A bid is accepted after it has been called three times. The highest bidder will receive the goods. The auctioneer will decide the bid in the event that several individuals bid on the same object simultaneously. If there is any doubt on the bid acceptance then the auctioneer may make a new call. In all cases the directive of the auctioneer is valid. The auction house may define minimum bids at their own discretion. If the minimum bid is not reached then the auction house may decline the bid or accept the bid under reserve. The bidder is bound to the bid for 7 business days. The bid expires if, during this period, the bidder does not receive notice of unreserved bid acceptance.

7. All prices are in Euro. The sales price consists of the hammer price (bid price) and a 18 % premium on the hammer price to be paid by the bidder. German VAT at the present rate of 19% will be charged on the premium and on the hammer price payable by the buyer.

8. Upon allocation the buyer is obligated to accept and immediately make payment. The goods auctioned off are considered as transferred upon acceptance of the bid to the highest bidder. Liability and risk of accidental destruction, loss or damage through fire, water, storm or theft is passed on to the buyer. This applies also to accessories. However, the ownership right will only pass on to the buyer after full payment has been received.

9. Full payment to the auction house is due upon bid acceptance on the auction or sales day in cash or via cashier's check. If the payment obligations are not met then the object of purchase is sold or up for auction again. However, the first buyer is not admitted to participate in the auction/sale. The first buyer is personally liable for the loss and has no right to a profit. The first buyer has no right to make any pecuniary claims against IVW GmbH & Co. KG.

10. Buyers from non-EC countries must pay the VAT. However, the VAT will be refunded to the buyer when submitting a stamped original export declaration. Bidders and buyers from EC countries may only be billed without sales tax upon presenting the sales tax identification number. We reserve the right to bill Euro 80.00 for each invoice for preparing export papers.

11. Only after payment has been received in full can the auctioned objects be picked up. It is understood that the prices for each object are from the base or location not disassembled and not loaded. Pick up is on the indicated dates, on business days between the hours of 8:00 am and 5:00 pm. Daily fees may be charged for late pick ups. These fees are calculated based on the respective storage and rental fees. The bidder or buyer or assistant bears the risk and costs of the disassembly and shipment of the objects. If the object has not been picked up during the pick-up period and after a one-time reminder notice, the auction house is entitled to place the object(s) again up for auction/sale as part of their compensation for damages. The loss and cost incurred are to be paid by the first buyer. The auction house will charge interest of 7.5% above the base rate on the purchase price as of the day the payment is in default, even if checks or bank drafts are provided.

12. The auction house is not liable for accidents occurring when inspecting the objects, during the auction and when picking up the object(s). It is strictly forbidden to start-up any equipment. Please follow the instructions set forth by the IVW GmbH & Co. KG staff. Unless otherwise noted, smoking is strictly prohibited. The buyer/visitor is liable for all damages and any type of accident caused.

13. The auctioneer, in his own name and to the expense of the instruction party, has the right to collect and sue for payment of goods and additional receivables.

14. A bidder who bids by order of a third party must present a power of attorney to be considered legitimate. He is liable as the sole debtor.

15. Invoices prepared immediately after the auction or sale, require a review to permit possible revisions.

16. Personal data necessary for the processing are recorded and stored in our files; please refer to the German Data Protection Act. The buyer agrees to store the data in our files for purposes of processing the agreement. The bidder or buyer will only receive a bid card upon presenting a valid personal identification. A copy of the identification is usually made. The copies are destroyed after the payment has been processed and the object(s) picked up.

17. Each bidder must carefully hold on to the bid card issued in his/her name until the auction is over. The bidder is liable for misuse of the bid number.

18. Ingelheim is the place of performance and jurisdiction.

Der Kunde ermächtigt die Firma IVW durch seine Registrierung, personenbezogene Daten zu erheben, zu speichern, zu verarbeiten und zur Abwicklung aktueller und zukünftiger Rechtsgeschäfte sowie eigene Zwecke zu nutzen (soweit dieses bei der Registrierung bestätigt wurde). Die vom Kunden personenbezogenen Daten werden im Rahmen der gesetzlichen Vorschriften verwendet. Mit der Registrierung bestätigt der Kunde sein Einverständnis über die Zusendung von Bekanntmachungen und Newslettern zu Angeboten (soweit dieses bei der Registrierung bestätigt wurde). Es wird garantiert, dass die vom Kunden übermittelten Daten nur zur Abwicklung und Werbung zwischen ihm und der Firma I-V-W verwendet werden.
